The Jicarilla Apache Nation Department of Labor shall determine whether a Business is eligible for Indian Preference pursuant to this Chapter.
Any Business that seeks Indian preference to provide goods or services in the Nation pursuant to this Chapter must be certified as eligible for Indian preference by the Jicarilla Apache Nation Department of Labor. Applications for certification may be obtained from the Department of Labor.
Certified Businesses are required to submit, within thirty (30) calendar days of the occurrence of a change, a detailed and accurate written report disclosing the occurrence of any and all changes in that Certified Business’ financial organizational, and/or operational status or composition as previously disclosed to the Jicarilla Apache Nation, including changes in ownership, location, personnel, management, control or any other business affairs which may affect the Certified business’ eligibility for Indian preference. The failure of any Certified Business to submit such information in a timely manner shall be subject to the sanctions and penalties set out in this Chapter and shall constitute grounds for revocation of certification or denial of any re-certification.
In order to be re-certified, each Certified Business shall submit annually, on or before the anniversary date of its original certification, the re-certification fee, a current federal income tax return, a current financial statement, and a verified written statement that §23-1-3(A)(3) has been fully complied with.
Falsification or Concealment of Information. Any person who omits falsifies or otherwise misrepresents or conceals information material to any determination authorized or required by this Chapter shall be subject to all applicable sanctions and penalties provided under this Chapter and any other applicable law of the Nation.
